Terms of Service

These Terms of Service (“Terms”) govern access to and use of the EDS platform and the edware.fr website, operated by EDWARE (SIREN 931 189 690, 33 rue de la Marzelle de Grillaud, Nantes, France — “EDWARE”, “we”, “us”). By accessing the website or using the EDS platform, you agree to these Terms. If you are acting on behalf of an organisation, you confirm you have authority to bind that organisation.


1. The EDS platform

EDS (Exercise Design for Simulators) is a cloud-based SaaS platform designed to support competency-based training and assessment (CBTA) for air traffic controller (ATCO) simulator training. Access is granted under a separate licence or subscription agreement signed between EDWARE and the client organisation. These Terms apply alongside that agreement; in case of conflict, the signed agreement prevails.

2. Permitted use

You may use the EDS platform and this website solely for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the platform in any way that violates applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the platform, its infrastructure, or other users’ accounts.
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the platform.
  • Use automated tools to scrape, crawl, or extract data from the website or platform without prior written consent.
  • Transmit malicious code, viruses, or any material that could damage or disrupt the platform.
  • Resell, sublicense, or otherwise transfer access to the platform to any third party without EDWARE’s prior written consent.

3. Accounts and access credentials

Client organisations are responsible for managing user accounts within their instance of the platform. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify EDWARE promptly at info@edware.fr if you suspect any unauthorised use of your account.

4. Intellectual property

The EDS platform, including its software, algorithms, design, documentation, and branding, is the exclusive intellectual property of EDWARE. Nothing in these Terms transfers any ownership rights to you.

Training content, exercises, and pedagogical data created by your organisation within the platform remain your organisation’s property. By using the platform, you grant EDWARE a limited licence to process that data solely for the purpose of providing the service.

5. Data and privacy

The collection and processing of personal data in connection with the EDS platform is governed by our Privacy Policy and, for client organisations, by the data processing agreement (DPA) signed at contract execution. EDWARE acts as a data processor for training data entered by client organisations, and as a data controller for contact and account data.

6. Service availability

EDWARE endeavours to maintain high availability of the EDS platform. Planned maintenance windows will be communicated in advance where possible. EDWARE does not guarantee uninterrupted access and is not liable for temporary unavailability due to maintenance, infrastructure issues, or circumstances beyond its control.

Specific uptime commitments and support response times, where applicable, are defined in the signed licence or subscription agreement.

7. Disclaimer of warranties

The edware.fr website is provided “as is” for informational purposes. EDWARE makes no representations or warranties regarding the accuracy or completeness of information on the website. The EDS platform is provided under the terms and warranties set out in the client’s signed agreement.

8. Limitation of liability

To the maximum extent permitted by applicable law, EDWARE shall not be liable for any indirect, incidental, or consequential damages arising from use of or inability to use the website or platform. EDWARE’s total liability to a client, in any case, shall not exceed the amounts paid by that client in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded under applicable law.

9. Third-party links and integrations

The website or platform may contain links to or integrations with third-party services (including ATC simulator vendors). EDWARE is not responsible for the content, availability, or practices of those third parties. Links do not imply endorsement.

10. Changes to these Terms

EDWARE may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the website or platform after changes are posted constitutes acceptance of the updated Terms. For material changes affecting existing platform clients, EDWARE will provide advance notice by email.

11. Termination

EDWARE reserves the right to suspend or terminate access to the website or platform for any user or organisation that breaches these Terms, without prior notice where the breach is serious. Termination of platform access for clients under contract is governed by the terms of the signed agreement.

12. Governing law and disputes

These Terms are governed by French law. Any dispute arising from or in connection with these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Nantes, France, unless mandatory consumer protection rules in your jurisdiction provide otherwise.
